Weidner: Prosecutors in the Madoff case ignore a bigger culprit

Prosecutors in Madoff case ignore culprit Commentary: Regulators had ample information to investigate fraudster

By David Weidner, MarketWatch
SAN FRANCISCO (MarketWatch) — For the victims of Bernie Madoff’s three-decade-old Ponzi scheme, there is some smug satisfaction today. J.P. Morgan Chase & Co., which had Madoff’s investment firm among its customers, will pay $1.7 billion under a deal announced Tuesday .
And while J.P. Morgan JPM -1.10%   deserves some culpability, it’s hardly the worst offender when it comes to ignoring warnings about Madoff’s too-good-to-be-true returns.

Commuters are reflected in stone as they walk past the JPMorgan headquarters in New York.
Prosecutors allege the bank failed to act on internal suspicions that Madoff’s trading activity and returns did not support his results. One of the key pieces of evidence is an email from one of the bank’s analysts that questioned, among other things, Madoff’s “odd choice” of a small, unknown accounting firm and concluded that the bank “seemed to be relying on Madoff’s integrity.”
“There are various elements in the story that could make us nervous,” the analyst wrote , including the “feeder” fund managers’ “apparent fear of Madoff, where no one dares to ask any serious questions as long as performance is good.”
It’s pretty damning evidence against J.P. Morgan. But, to be fair, the email was written in October 2008, just two months before the Madoff family turned in their dad. Madoff’s Ponzi scheme ran for more than 30 years. And serious concerns about his activities were brought to regulators’ attention at least a decade before.
Harry Markopolos, the former fund manager who was charged by his investment company to match or exceed Madoff’s returns in the late 1990s, built a devastating case against Madoff. He brought his conclusions to the Securities and Exchange Commission multiple times more than a decade ago only to be shown the door.
This isn’t to say there aren’t a lot of players in the Madoff saga who looked the other way. Friends, family, employees, banks, investors, feeder funds — most of them kept their mouth shut out of greed or indifference. But shouldn’t we hold those whose job it is to police the markets to a higher standard?
Maybe the SEC doesn’t have the deep pockets of J.P. Morgan. But that doesn’t mean it should be excused for failing to do its job, especially when a third party private institution and its shareholders are paying a price.

J.P. Morgan banker joked about Madoff
One senior J.P. Morgan executive quipped that the bank should visit Bernie Madoff’s accounting office just to make sure it wasn’t actually a car wash.
J.P. Morgan settles Madoff charges for $2.6 bln
Weidner: We’re at the mercy of J.P. Morgan

Extrait :

It’s now clear that J.P. Morgan is the market — and not a very stable one.
Time is running out. It’s an election year. Uncertainty is in the air. There is only one real choice. Lew calls Janet Yellen, chairman of the Federal Reserve, and speaks gravely.
“Janet, we need to make preparations for a bailout,” Lew says.
If this little allegory sounds far fetched, consider what’s happened since 2008. J.P. Morgan, with $2 trillion in assets, has become the nation’s biggest bank. It now controls 13.6% of the banking assets in the U.S. market. That’s triple the amount J.P. Morgan and its legacy banks controlled in 1990, according to new data released by SNL Financial.
Moreover, J.P. Morgan is the biggest of what has become an elite tier of mega banks. It’s just one of five — Citi, B. of. A, Wells Fargo & Co. WFC +1.15%  and U.S. Bancorp USB +0.22%  — that together now control 44% of the nation’s banking assets. Their combined share has climbed 30% in the last decade as assets have soared to $6.46 trillion from $2.2 trillion.
So size and importance to the financial system isn’t really in question. But what about the events that led to our imagined crisis?
Consider bad loans. J.P. Morgan isn’t making them anymore, right? Well, who really knows? Of the roughly $70 trillion in A-rated collateralized debt obligations underwritten in 2006 and 2007, more than half were downgraded to junk status by 2009. J.P. Morgan wrote down $5.5 billion in assets on its books, and has absorbed more than $20 billion in settlement costs for missteps during the mortgage boom, including faulty debt products it sold to investors.
This isn’t to say J.P. Morgan is doing the same work it did in the run up to the crisis, but it is to say we just don’t know for sure how, when, where or why a panic in a bank begins.
Another explosive risk that’s unpredictable: trading debacles. Consider J.P. Morgan’s own “London whale” scandal. An escalating bet on corporate debt in Europe turned into billions of losses in 2012. It was overlooked, then underestimated by senior officials at the bank for months. J.P. Morgan has argued that the “whale” debacle was the result of ground-level mistakes in its London office and a lack of controls. Critics say senior officials ignored the steepening losses.
Either way, the bank posted nearly $8 billion in losses from the trades and fines. It also took a crippling hit to its confidence.
J.P. Morgan, of course, survived the London whale and the financial crisis because it was the biggest bank on the block. Its balance sheet and diversification allowed it to absorb the London whale losses. Its sheer size and relative health to the industry gave it special status with a government seeking a financial stalwart to rescue failing rivals (Bear Stearns and Washington Mutual).
But what if the institution itself was hit with the perfect storm? Today J.P. Morgan has never been bigger or more integral to the marketplace. Too big to fail? J.P. Morgan is beyond that. If it fails, we do.

BANQUIERS MORTS : JP MORGAN 5 - GOLDMAN SACHS 0

  • - Joseph Giampapa, directeur juridique
    - Gabriel Magee, vice-président du département investissement high-tech Europe.
    - Ryan Henry Crane, cadre supérieur trading.
    - Li Junjie, trader Forex.
    - Jason Alan Salais, informaticien avec plusieurs niveaux d'accreditation.

    Journaliste:

Une assurance vie dont la banque est le bénéficiaire "And yet, somehow, banks are allowed to collect death benefits on terminated workers right under the nose of State insurance regulators. The explanation is likely the secrecy which surrounds these policies, limiting knowledge of death payments to just the bank and the insurance company." meme payé par les bailout et les compensations sont exempt d'impots"...

    - James Stuart, Wells Fargo, Citi.
    - Adnan Sakli, banquier américain sulfureux
